Do you need insurance for a moped in Florida?

By Michal Belica, owner of Miami Beach Scooter, in Miami Beach since 1998. Last reviewed October 29, 2026.

No. Florida doesn't make you buy insurance to register or ride a moped or a 50cc scooter. The no-fault (PIP) law only applies to vehicles with four or more wheels, and the state asks for proof of insurance at registration only for those. You need a plate, a regular driver's license and, on the 50cc scooters we sell, a title.

That title is the part almost nobody mentions, and it changes what happens after a crash. We hear this question at the counter almost every week, so here's the full answer.

50cc scooter Over 50cc
License Regular Class E Motorcycle endorsement
Paperwork (the scooters we sell) Plate, title and registration Plate, title and registration
Insurance to register No No
Proof of liability after certain crashes Plan on yes, unless it's a true pedal moped Yes, $10k / $20k / $10k

What counts as a moped in Florida

The legal definition is older than most of the scooters on the road. Florida calls it a moped when the engine is 50cc or smaller, makes no more than 2 brake horsepower, can't go faster than 30 mph on level ground, shifts by itself, and, written back when mopeds had them, has pedals (s. 316.003).

Most 50cc scooters sold today have no pedals.

That's why a new 50cc like the Wolf RX-50 leaves our shop with a plate, a title and a registration, the same paperwork as a 150. FLHSMV doesn't title true mopeds at all; it treats them as "registration only" vehicles.

Your license is a separate question, and the answer there is simple. The licensing law calls only engines over 50cc motorcycles (s. 322.01), so any 50cc rides on a regular Class E license.

Why insurance isn't required on a 50cc

Two laws decide it.

The first is the no-fault law, the one that makes every car owner carry personal injury protection. It applies only to vehicles with four or more wheels (s. 627.732). A scooter has two, so there's nothing to show when the plate goes on.

The second is the financial responsibility law. It doesn't make anyone buy a policy up front. It kicks in after certain crashes and violations: the state can demand proof of liability coverage of at least $10,000 per person and $20,000 per crash for injuries, plus $10,000 for property damage (s. 324.021). Can't show it, and your license and registration can be suspended for up to three years (s. 324.051).

That law leaves out bicycles, electric bicycles and mopeds by name. Plenty of websites stop there and tell 50cc riders they're exempt. But a 50cc without pedals doesn't meet Florida's moped definition, and the state titles it instead of treating it as a registration-only moped. So plan on this law applying to yours.

What you do need

Insurance isn't on the list. These are:

  • A plate, a title and a registration. We do all three, plus the sales tax, at the counter when you buy, so most of our buyers never see the DMV. As I say in our videos, we get you out within an hour.
  • A regular Class E driver's license. No motorcycle endorsement for 50cc.
  • A helmet and eye protection. The helmet law requires a helmet under 16 on a moped and under 21 on a motorcycle, plus eye protection on a motorcycle. A 50cc without pedals doesn't meet the moped definition, so go by the motorcycle rule: riders 21 and older can skip the helmet only if they carry $10,000 in medical coverage (s. 316.211).

Over 50cc: the license is the difference

Move up to a 125 or a 150 and you need a motorcycle endorsement on your license. The paperwork is the same plate, title and registration, insurance still isn't required to register it, and the financial responsibility law applies after certain crashes, no question.

Anything over 50cc is a motorcycle under the law, even when it looks exactly like a scooter. So is a 50cc that's been tuned to go faster than 30 mph. Two bikes can sit side by side in our showroom, same body, same color, and need different licenses because of the engine.

Why we still tell every buyer to get liability coverage

"Not required" only means the state won't ask when you register. It doesn't mean nobody will ask later.

Clip a parked car on Alton Road or knock down a cyclist on Washington Avenue, and two things can happen. The state can ask for proof of coverage, and the other person can hold you personally responsible for the damage. With no policy, both land on you.

Here's how I put it in our insurance video: "If you ask me for personal advice, I recommend liability insurance for every 50cc scooter. It can cost you as little as $10 a month, and if you accidentally hit a Ferrari or a Rolls-Royce, the insurance pays, not your pocket."

In Miami Beach the Ferrari isn't a figure of speech.

Three questions to ask your agent

Liability is the one every rider should have, and it's the coverage that answers the state after a crash. After that, it depends on how you ride:

  • You ride every day: what covers my own medical bills if a car hits me?
  • It sleeps outside, or it's brand new: does this policy cover theft?
  • You deliver food or packages: am I covered while I'm working? Say it out loud, because personal policies often treat business use differently.

And ask for a scooter or motorcycle policy by name instead of assuming your car policy stretches to two wheels.

Quick answers

How much is insurance on a 50cc moped?

It depends on your age, your record and the coverage you pick. Liability only is the cheapest place to start; adding theft and medical costs more. Get two or three quotes for your exact model before you ride.

Do you need insurance for a scooter in Florida?

Not to register or ride it, whatever the engine size. After certain crashes, though, the state can ask for proof of $10,000 / $20,000 / $10,000 in liability coverage on any scooter that isn't a true pedal moped, and that includes a titled 50cc.

Is insurance required for a motorcycle in Florida?

Not to register it. After certain crashes the state can require proof of at least $10,000 / $20,000 / $10,000 in liability coverage, and riders 21 and older who skip the helmet must carry $10,000 in medical coverage.

Can I register a scooter without insurance?

Yes. Florida asks for proof of insurance at registration only for vehicles that need PIP, and those have four or more wheels (s. 320.02). Buy from us and we handle the plate, title and registration at the counter. One catch from FLHSMV: if you do insure it, surrender the plate before you cancel the policy, or you risk a license suspension.

Do I need a motorcycle license for a 50cc scooter?

No, a regular Class E license is enough. Our 50cc scooter guide and the list of the best 50cc scooters you can ride without a motorcycle license go model by model, and the Florida scooter laws page covers parking and where you can ride.

Shopping for a 50cc? New ones start at $1,449 and used ones at $499, with over 100 new and over 30 used at 1743 Bay Rd, Miami Beach. See what's in the showroom, message us on WhatsApp at (786) 498-7208 with any insurance or registration question, or come by Monday to Saturday, 10am to 7pm.

Scooter Maintenance 101: Tips for Keeping Your Scooter in Top Condition

Scooters are an excellent mode of transportation, offering convenience, cost-effectiveness, and fun. However, like any vehicle, they require maintenance to function efficiently and prolong their lifespan. Regular scooter maintenance not only helps prevent breakdowns but also ensures that your scooter remains safe and performs optimally. As a scooter expert, I'll be sharing some essential tips for keeping your scooter in top condition.

  1. Check the Oil Regularly: Regular oil checks are crucial to keep your scooter's engine lubricated and running smoothly. Most scooters have a dipstick that allows you to check the oil level easily. Check the owner's manual to see the recommended oil type and how often you should change it.

  2. Inspect the Tires: Your scooter's tires are the only point of contact with the road, so it's crucial to keep them in good condition. Check for signs of wear and tear, such as cracks, punctures, or low pressure. Inflate the tires to the recommended pressure, which can be found in the owner's manual.

  3. Keep the Battery Charged: The battery powers the starter motor and electrical systems in your scooter. Check the battery regularly and charge it if necessary. If you store your scooter for an extended period, remove the battery and store it in a dry, cool place.

  4. Check the Brakes: The brakes are an essential safety feature in your scooter. Check the brake pads for wear and replace them if necessary. Also, check the brake fluid level and top it up if it's low.

  5. Clean the Air Filter: The air filter keeps dust and debris from entering the engine. Over time, the air filter becomes clogged and affects the engine's performance. Clean or replace the air filter regularly, as recommended in the owner's manual.

  6. Lubricate Moving Parts: Your scooter has several moving parts that require lubrication to reduce friction and wear. Use a lubricant recommended in the owner's manual to lubricate the chain, cables, and other moving parts.

  7. Get Regular Service: Regular servicing by a qualified mechanic is essential for maintaining your scooter's optimal performance. A mechanic can detect potential problems early and perform the necessary repairs or replacements.

In conclusion, proper scooter maintenance is crucial for your safety and the scooter's longevity. Follow these tips to keep your scooter in top condition and enjoy a smooth, safe ride. If you're unsure how to perform any of the maintenance tasks, seek help from a qualified scooter mechanic. Remember, regular scooter maintenance will save you money in the long run by preventing costly repairs and replacements.

Scooter rental safety tips for travelers in Miami Beach

Scooter rental has become increasingly popular among travelers visiting Miami Beach. Whether you're looking to explore the city's vibrant streets or beat traffic on your way to the beach, scooter rentals offer a fun and convenient way to get around.

However, it's important to keep safety in mind while riding a scooter in Miami Beach. Here are some tips to help you have a safe and enjoyable experience:

  1. Always wear a helmet. This is the most critical safety tip for scooter riders. Helmets protect your head in the event of a crash and can prevent serious injuries. The best rental companies, such us ours, provide helmets for their customers.

  2. Follow traffic laws. Just like any other vehicle, scooters must follow traffic laws and signals. This means stopping at stop signs, yielding to pedestrians, and staying in designated lanes. Be aware of your surroundings and pay attention to other vehicles on the road.

  3. Avoid distractions. Riding a scooter requires your full attention. Avoid using your phone or listening to loud music while riding, as these distractions can put you and others in danger. Keep your eyes on the road and your hands on the handlebars at all times.

  4. Stay sober. Alcohol and drugs impair your ability to operate a scooter safely. If you're planning on drinking or using drugs, it's best to avoid riding a scooter altogether. Not only is it dangerous, but it's also illegal to operate a vehicle while under the influence.

  5. Use designated scooter parking areas. Scooters can be convenient for getting around Miami Beach, but they can also take up space on the street. To avoid blocking traffic or sidewalks, use designated scooter parking areas when possible.

By following these safety tips, you can have a fun and enjoyable experience while renting a scooter in Miami Beach. Remember to always wear a helmet, follow traffic laws, avoid distractions, and stay sober while riding. By keeping safety in mind, you can help ensure a smooth and enjoyable ride.
